AIDE-MEMOIRE FOR PS

INTRODUCTION ON COMMENCEMENT OF TAPED-INTERVIEW

Before beginning the interview, ensure that all Welfare issues have been addressed, including any complaints that the D/P or Solicitor have –Check D/P has had adequate food / drink & medication etc.

ASAP Load CD/tape recorder in sight of the subject and any others present, set it to record and state:

“This interview is being (visually and) tape recorded and it may be given in evidence if your case is brought to trial. At the conclusion of the interview, I will give you a notice explaining what will happen to the

This interview is being conducted in an interview room at…………………Police Station.

“I am (rank and name) ……………... attached to ………….….. Police Station

“The other officer(s) present is/are (rank and name)……………………….

The date is……………………and the time is…………………note time on seal from the interview room clock)

“I am interviewing ………………… (ask subject to state full name and date of birth).”

“Please speak in a clear and audible manner.”

“There is no other person present” or “Also present is:-

(a)? Solicitor / Legal Representative – Ask Solicitor to state name and firm.

At this point the solicitor may make a statement, explaining their role. If they do not, consider explaining their role on tape as listed below:-

“Your role is to protect and advance your client’s basic and legal rights”;

(b) Appropriate Adult – Ask person to state name and relationship with subject, then inform them:

“You are not expected to act simply as an observer and the purposes of your presence are, first

“You are reminded that you have the right to free and independent legal advice. You may at any time consult or communicate privately either in person, in writing or on the telephone with a solicitor.

If you do want legal advice, the interview can be delayed unless certain exceptions apply.

If the subject has declined to speak to a solicitor either in person or on the telephone, ask:

“You are not obliged to give your reasons to why you don’t want legal advice. Are you prepared to tell me why you don’t want legal advice?”

“I understand that previously you asked for legal advice but you since changed your mind. You spoke to Inspector (name)…………………..and told the officer that you no longer wanted legal advice because (state reason) and the Inspector then gave authority for the interview to go ahead. “This is my opportunity to question you regarding this matter. It is also your opportunity to give an explanation regarding the matter if you wish. There will be pauses;and so that you have an opportunity to formulate your answers. The pauses are not intended to intimidate you.”

Caution & Suggested Explanation

“You do not have to say anything, but I must caution you that if you do not mention when questioned, something which you later rely on in court, it may harm your defence. If you do say anything it may be given in evidence.”

“The best way that I can explain that Caution to you is based upon the interpretation provided by the ‘Plain English Society’ which is:”

If the Solicitor later objects and you have addressed the above issues prior to commencing the Taped Interview, you now have the opportunity to say:

“Prior to interview I asked you whether or not all your client’s Welfare issues had been addressed, including any complaints that you had. These were dealt with prior to interview. I am surprised that you have prolonged your client’s detention by only now stating your concerns. I am stopping the interview to deal with these concerns in order not to waste any further time.” -

STOP THE INTERVIEW.

If you do say anything it may be given in evidence.

Explanation to be provided to an adult (if applicable) prior to interview for a suspected offence where the diversion scheme is appropriate

“………………………., you are to be interviewed in relation to your suspected involvement in the commission of an offence. In the view of the fact you are an adult this matter may be dealt with in a number of ways should there be sufficient evidence to proceed. Should this be the case the potential outcomes are; Informed Warning, Adult Caution, or being referred for Prosecution. An Informed Warning or Adult Caution may only be given if you admit your involvement in the commission of this offence. However, even if you admit the offence, you may still be referred for prosecution through the courts.

The method of disposal will be decided once all the facts of your case have been considered, including any previous offending history you may have, the seriousness and gravity of the offence(s) involved.

Both an Informed Warning and an Adult Caution are recorded on Criminal Record although neither are a conviction, prosecution will result in conviction, whish is recorded on Criminal record. All of the aforementioned disposals may be disclosed in any subsequent proceedings”.

Explanation to be provided to a child/young person (juvenile) and their appropriate adult – prior to interview for a suspected offence

In the view of the fact you are a juvenile this matter may be dealt with in a number of ways should there be sufficient evidence to proceed with the case. The potential outcomes are an Informed Warning, Restorative Caution, or being referred for Prosecution. An Informed Warning or Restorative Caution may only be given if you admit your involvement in the commission of this offence. However, even if you admit the offence, you may still be referred for prosecution through the courts.

The method of disposal will be decided once all the facts of your case have been considered, including any previous offending history you may have, the seriousness and gravity of the offence(s) involved. Consideration will also be given to any specific and relevant information provided to police by the Probation service, Education Welfare Service, Social Services or the Youth Justice Agency, if you are, or have recently been engaged with one or any of them.

Both an Informed Warning and a Restorative Caution are recorded on Criminal Record although neither are a conviction. A prosecution may result in conviction, which is recorded on Criminal Record. All of the aforementioned disposals may be disclosed in any subsequent proceedings”
